RELEASE OF LIABILITY
**Rocky Mountain Devo, LLC - Waiver and Release of Liability**

In consideration of my participation in any activities provided by Rocky Mountain Devo, LLC, whether in person or through https://www.rockymountaindevo.com, I acknowledge and agree to the following terms:

1. **Assumption of Risks:**
I acknowledge that I hereby assume all risks associated with participating in any activities conducted by Rocky Mountain Devo, LLC. These risks include, but are not limited to, those arising from negligence, carelessness, dangerous or defective equipment, and the possible liability without fault of persons or entities involved.

2. **Physical Fitness Certification:**
I certify that I am physically fit, have adequately prepared or trained for participation in the activities, and have not been advised against participation by a qualified medical professional. I also certify that there are no health-related reasons or problems that prevent my participation.

3. **Accident Waiver and Release of Liability:**
I hereby waive, release, and discharge Rocky Mountain Devo, LLC, and their directors, officers, employees, volunteers, representatives, agents, as well as the activity holders, sponsors, and volunteers, from any and all liability for death, disability, personal injury, property damage, property theft, or any other actions that may occur during or in connection with my participation in the activities.

4. **Indemnification and Hold Harmless Agreement:**
I agree to indemnify, hold harmless, and promise not to sue Rocky Mountain Devo, LLC, and all entities or persons mentioned above, from any liabilities or claims arising as a result of my participation, whether caused by their negligence or otherwise.

5. **Acknowledgment of Risks:**
I acknowledge that the activities may involve a test of physical and mental limits and carry the potential for death, serious injury, and property loss. Risks include, but are not limited to, terrain, facilities, weather conditions, participant conditions, equipment, vehicular traffic, lack of hydration, and actions of other people.

6. **Medical Treatment Consent:**
In the event of injury, accident, and/or illness during the activities, I hereby consent to receive medical treatment deemed advisable by qualified medical personnel.

7. **Media Release:**
I understand that I may be photographed during the activities and agree to allow my photo, video, or film likeness to be used for any legitimate purpose by the activity holders, producers, sponsors, organizers, and assigns.

8. **Construction of the Waiver:**
The Accident Waiver and Release of Liability Form shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.

9. **Certification of Understanding:**
I certify that I have read this document, fully understand its content, and am aware that it is a release of liability and a contract. I sign it of my own free will.

By checking the privacy policy and release of liability box for appointments, services, or coaching, signing below, and/or using any services or functions of Rocky Mountain Devo, LLC, I acknowledge my agreement to the terms outlined in this Exercise Testing Waiver and Release.
