Rocky Mountain Devo, LLC - Waiver and Release of Liability
By participating in any training, coaching, testing, or activities provided by Rocky Mountain Devo, LLC, in person or online, I knowingly and voluntarily assume all risks associated with participation, including those arising from physical exertion, equipment use, environmental conditions, and the actions or negligence of others. I certify that I am physically able to participate, have adequately prepared, and have not been advised otherwise by a qualified medical professional. I hereby waive, release, discharge, and hold harmless Rocky Mountain Devo, LLC, and its owners, staff, contractors, and affiliates from any and all claims for injury, illness, disability, death, or property loss arising from my participation, whether caused by negligence or otherwise. I agree to indemnify, defend, and hold harmless Rocky Mountain Devo, LLC against any and all such claims. I consent to emergency medical assessment and treatment by qualified personnel if deemed necessary and acknowledge that Rocky Mountain Devo, LLC is not responsible for the outcome of such care. I grant permission for use of photos or video for legitimate business purposes. I acknowledge this is a binding legal contract and agree voluntarily.
Medical & Physiological Testing Addendum
Testing data, results, and interpretations provided by Rocky Mountain Devo, LLC are not medical diagnoses and should not be used to make medical decisions. Rocky Mountain Devo, LLC does not provide medical treatment or medical advice. All physiological testing (including but not limited to VO₂ max, lactate testing, metabolic analysis, and exercise assessments) is for educational, informational, and performance purposes only and is not a substitute for medical evaluation or care. Participation in testing is voluntary and performed at the client’s own risk. Clients are strongly encouraged to complete the PAR-Q+ and to consult a physician prior to testing if any health concerns exist. By proceeding, I acknowledge that I am responsible for my own medical clearance and assume all risks associated with exercise testing.
I acknowledge that strenuous exercise and physiological testing involve inherent cardiopulmonary risks, including but not limited to shortness of breath, dizziness, fainting, abnormal heart rhythms, chest pain, heart attack, stroke, or sudden cardiac events, which may occur during or after testing with or without known medical conditions, and I knowingly and voluntarily assume all such risks.
Participation in firefighter, law enforcement, military, or first responder fitness testing may involve elevated risk due to job-specific physical demands, protective equipment, heat stress, respiratory load, and maximal exertion. I acknowledge that such testing carries increased risk of musculoskeletal injury, heat illness, respiratory distress, rhabdomyolysis, cardiovascular events, and delayed post-exercise complications. I understand that Rocky Mountain Devo, LLC is not acting on behalf of any employer, agency, or governing body and that participation is voluntary and not a condition of employment unless required by my employer. I acknowledge that testing results are provided for performance and educational purposes only and do not constitute medical clearance, medical certification, or determination of job fitness. I assume all occupational and physiological risks associated with participation.
Participation in employer-sponsored or corporate wellness testing and training services through Rocky Mountain Devo, LLC is entirely voluntary and is not a condition of employment, promotion, or job retention. I understand that Rocky Mountain Devo, LLC is not acting as an agent of my employer and does not make employment, disciplinary, or job-placement decisions. I acknowledge that all testing and training services are provided solely for educational, performance, and wellness purposes and do not constitute medical evaluation or occupational fitness certification. I understand that my individual testing data will not be shared with my employer without my explicit written consent, except as required by law or regulation. I assume all personal risks associated with participation.
Minor Participant & Parent/Guardian Consent Addendum
If the participant is under the age of 18, I certify that I am the participant’s legal parent or court-appointed guardian and that I have full legal authority to execute this waiver on their behalf. I acknowledge and agree that the minor is bound by all terms of this Exercise Testing Waiver and Release as if they were an adult. I voluntarily assume all risks associated with the minor’s participation on behalf of myself and the minor and agree to release, indemnify, defend, and hold harmless Rocky Mountain Devo, LLC from any and all claims arising from the minor’s participation, including those based on negligence. I consent to emergency medical assessment and treatment for the minor if deemed necessary.
By checking the privacy policy and release of liability box for appointments, services, or coaching, signing below, and/or using any services or functions of Rocky Mountain Devo, LLC, I acknowledge my agreement to the terms outlined in this waiver and release of liability. This agreement is valid whether signed electronically, digitally, or in written form.
